Make a Thai 'Last Will' or not
It is not required by law to make a will in Thailand but by making a will you decide what happens to your assets and possessions (the estate) when you die. If you die without a last will or testament the statutory rights of succession will determine who gets what of your estate after your death. Without a written last will your assets will be distributed according to the law rather and maybe not according to your wishes.

Forms of Last Wills

The most common form of last will in Thailand is a will according to section 1656 of the Thailand Civil and Commercial Code. This is a will in writing, dated at the time of making of the will and signed by the testator before at least two witnesses present at the same time. A witness cannot be a beneficiary of the will and should be an independent witness.
In the will the testator can chose one or more persons to be executor or joint executors of the will. The executor will deal with the division of the assets and possessions after the testator’s death. If no testator is appointed under Thai law the Court will appoint an executor. The appointed executor or administrator of the will can be a beneficiary of the will. It is generally recommended to appoint an executor and substitute executor in the will.
The will includes the details of all beneficiaries (full name and their relationship) and what you are leaving to them. The will states the testators wishes how his estate is shared and who gets what. A will made in Thailand can specifically deal with assets in Thailand and the testator could limited the effect of the will to his estate within the jurisdiction of Thailand.
After the will is made it is recommended to keep the will in a safe place. It is possible to change and update the will later as as circumstances change. In this case it is possible to make alterations or to add supplementary changes which must be properly witnessed, or the will is revoked and a new will is made.
